Breaking News: Senate Passes Social Security Fairness Act to Eliminate WEP & GPO, Awaiting Presidential Signature

In a landmark decision, the U.S. Senate has passed the Social Security Fairness Act, paving the way for the elimination of the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). This bipartisan legislation, spearheaded by U.S. Representatives Abigail Spanberger (D-VA-07) and Garret Graves (R-LA-06), now moves to President Biden’s desk for final approval. If signed into law, the bill will bring long-overdue retirement fairness to nearly 2.5 million Americans who dedicated their lives to public service, including police officers, firefighters, educators, and federal workers.


Correcting Decades of Retirement Inequity

The WEP and GPO, introduced in 1983 as amendments to the Social Security Act, have unfairly reduced or eliminated Social Security benefits for millions of public servants.

  • The WEP penalizes individuals who worked in jobs not covered by Social Security but who also held part-time or second jobs that required Social Security contributions. For instance, teachers who worked summer jobs or part-time roles often face reduced benefits, even after meeting the required contributions.
  • The GPO affects spousal and survivor benefits, reducing them by two-thirds for public employees who receive a government pension. In many cases, this offset completely eliminates the benefits widows or widowers rely on during retirement.

Together, these provisions have denied millions of Americans their earned retirement security, often leaving them with significantly reduced income during their later years.


A Bipartisan Effort to Address Retirement Injustice

The Social Security Fairness Act is the result of years of bipartisan advocacy. Representatives Spanberger and Graves reintroduced the legislation in January 2023, working tirelessly to gather support and push the bill through Congress.

In their joint statement, the lawmakers emphasized the significance of this achievement:

“Finally, Congress showed up for the millions of Americans — police officers, firefighters, teachers, federal employees, and other local and state public servants — who worked a second job to care for their families or began a second career to afford to live. Congress showed up for the hundreds of thousands of widows and widowers who are denied their spouses’ Social Security benefits while grappling with their loss.”

Their efforts culminated in a discharge petition signed by 218 House members, forcing a vote in the U.S. House, where the bill passed with strong bipartisan support. The Senate’s approval marks the final legislative step, leaving only the president’s signature to enact this transformative law.


Who Will Benefit from the Social Security Fairness Act?

The repeal of the WEP and GPO will restore earned benefits to millions of Americans:

  • Police Officers & Firefighters: Those who serve in public safety roles often face reduced benefits due to the WEP and GPO, despite contributing to Social Security through second jobs.
  • Educators: Teachers in public schools often do not pay into Social Security for their primary roles but lose out on earned benefits from other jobs or spousal benefits due to these provisions.
  • Federal, State, & Local Government Employees: Public servants who have dedicated their careers to government work will finally receive fair treatment in retirement.

A nonpartisan 2024 report revealed that:

  • The WEP reduces benefits for more than 1.7 million Americans.
  • The GPO negatively impacts over 420,000 beneficiaries.
  • Over 320,000 retirees face penalties under both provisions.

The Path Forward: Presidential Approval

With the Social Security Fairness Act now on the president’s desk, millions of retirees are eagerly awaiting the final step in this process. Signing this bill into law will mark a historic moment in the fight for retirement fairness, ensuring that public servants receive the benefits they rightfully earned.

Spanberger and Graves remain steadfast in their commitment to seeing this bill signed, stating:

“We will not take our foot off the gas until this bill reaches the president’s desk and is signed into law to repeal the WEP and GPO.”
